George Sax was a featured panelist on a recent PLAC, Inc. (Product Liability Advisory Council) webinar regarding the potential liability for employees returning to the workplace during the unprecedented and challenging times of COVID-19. The webinar took place on July 9, 2020 and was the first of three webinars that PLAC is offering its members this summer addressing various topics surrounding liability issues related to COVID-19. The panel addressed best practices for reopening and avoiding/limiting liability and how employers will need to take steps to protect their employees from exposure and themselves from liability. Employees are already suing their employers for workplace exposure. Mr. Sax has been closely monitoring these lawsuits and provided an analysis of current litigation in Illinois, Nevada and Texas. Mr. Sax discussed what theories plaintiffs have been advancing and how much traction they have gotten. The panel concluded with a discussion of efforts that are underway at the federal and state level to shield employers from liability for workplace exposure.
