On October 27, 2016, Corinne C. Heggie spoke at the National Creditors Bar Association’s Fall 2016 Conference in Las Vegas, Nevada. Ms. Heggie participated in a panel discussion entitled “Life After Pressler and the Bar on Pre-Judgment Discovery.” The panel spoke to a standing-room only crowd when it examined the prohibition on pre-judgment litigation discovery articulated in the consent order entered in the spring between the Consumer Financial Protection Bureau (“CFPB”) and the law firm of Pressler & Pressler LLP. The panel’s discussion of cases pre- and post- consent order that bear on collection litigation, the significance and use of pre-judgment litigation discovery, and compliance considerations for the industry prompted many questions after the presentation.
