In a victory for one of the Firm’s pro bono clients, attorneys George Sax and Eric Quandt won a Daubert challenge in an action filed in the United States District Court for the Northern District of Illinois. See McDonald v. Wexford Health Sources, Inc., 2016 U.S. Dist. LEXIS 47286. In a written opinion, the federal court held that the death of a defense expert whose report and deposition testimony rested on uncertain ground does not entitle the defense to a do-over with a new expert. Thus, the court denied a defense motion to reopen expert discovery in a lawsuit that accuses the defendants of providing substandard care to an inmate of a state prison.
